The present conditions which rule our company " Passionnement Terroir" are available on our website http://www.passionnement-terroir.fr or http://www.passionterroir.fr .
When placing any order with our company the buyer accepts these General Conditions of Sales without qualification and in their entirely to the exclusion of any other document .
1- Acceptation of these present general conditions of sales.
The fact that the buyer fills in the order form and confirms its order by clicking on "Confirm your order" makes full agreement of the GCS which will be the only ones applied to the contract thus created.
2- Confirmation of the order
The conclusion of the contract will not be considered final until confirmation of the order by the services of our company "Passionnement Terroir" .After validation of the payment, the order is accepted by our company and confirmed to the buyer according to the different ways of communication: E-mail, phone, fax, or written and by post .This confirmation or eventually refusal, will be noticed to the buyer within 24 hours. After reception of the order, our company keeps the rights not to confirm any order, in case of a problem with the supply of the goods for any reason by local producers, any problem concerning the received order, or any problem in the delivery. The buyer cannot cancel the order after reception of the confirmation of that order.
3- Rights and modalities of returns
The buyer can have up to 15 days after delivery to return to the seller, at the buyer's expenses, in its original packaging, for an exchange or a refund. During this period, the guarantee of sending back is total: no justification will be asked. Therefore, no replacement or return will be accepted for goods which dates have expired. This guarantee is not available for perishable goods. Packaging must absolutely be sent to the following address:

The customer must also send with the packaging a copy of the invoice on which he will have encircled the returned products.
The refund will be made within 15 days after reception of the goods.
If this procedure is not respected, our service can meet complications to record your package, even be in inability to identify it and to reimburse you. The service of returns has the right to refuse any package not answering these criteria.
4- Prices.
Prices written in euros include the VAT but not the delivery charges. The prices are those available the day the order is registered. The orders must be paid in euros only : - by credit card - by cheques and sent before the delivery of the order - by transfer : Your order will be sent to you as soon as your credit transfer payment is made and delivered in our office. * Foreign credit transfers in the EU (EURO area) : make a EUROVIR credit transfer (you may have extra fees according to your own bank brand and/or your country). * Foreign credit transfers out the EU (EURO area) : please add an extra 30€ all-in fee to the total of your order to cover the extra expenses at the reception of your credit transfer (You may have extra charges from your own bank and/or according to your country).
The strict care about information does not protect us from eventual error. If such error occurs the order would only be registered after informing the buyer and having received back the confirmation, within 24 hours.
In application of law n° 80.335 (12 May 1980 ) the merchandise remain our property until complete payment of their cost.
5- Charges.
The charges are clearly calculated on-line and shown immediately on the order page, depending on the quantity, the weight, and the country where the goods must be delivered.
6- Delivery and period times.
Orders are treated in the shortest possible time by our logistical platform, opened from Monday till Friday included except bank holidays. Once your confirmation of order received by email, we promise to deliver your order in 5 days for the available products (in supply), and in 15 days for products which are not available (not in supply). Nevertheless, if a product is in complete and final break of supply (stopping of the product), we shall be in inability to deliver it. You will then be informed of this situation, and we will see with you that we will do (refund or replacement of the product). For deliveries abroad, we have several partners and perform an express shipping, delivery times varying according to destination. Delivery time is variable according to the chosen mode of expedition, destination and the period of the year. " Passionnément Terroir " can be consider as the responsible of the long delivery time of the conveyors partners.
7- Rights, taxes and customs.
The regulations are made by EU. Any delivery in Europe is charged with the French VAT. For deliveries outside Europe there will be no VAT. Customs charges will be paid by the receiver of the order. Those taxes are not the responsibility of the seller. The buyer must get information about imports or any goods delivered in a foreign country.
8- Damages
The risk in the goods and particularly those risks inherent in their carriage shall pass to the buyer immediately upon their delivery. The buyer must add the words "avec reserves" before signing the delivery receipt. A copy of those reserves must be sent by E-mail or by fax within 24 hours after signing. It is the buyer's responsibility to take all necessary steps to ensure that his rights are safeguarded with respect to the carrier of the goods by taking all necessary precautions. Once the buyer has sent his complaint within the specified time, and provided the seller with all evidence regarding defects or anomalies reported, and is not satisfied with the quality, "Passionnement Terroir "will, to the buyer's choice, make a new delivery of similar goods for the same amount or a refund.
9- How to pay and secured payment on-line.
If you choose to pay on-line with a credit card, you are immediately sent to the secured website of our bank using the SSL protocol. Encryption scrambles the personal information you provide. You can tell when you are on a secure website if you look for a closed padlock displayed at the bottom of your screen. The personal information are not at all stored in our computer, they just get through to the protected site of the bank.
If you wish to pay by cheque, you must send it with your order reference to the following address :

ONLY CHEQUES FROM FRENCH BANK WILL BE ACCEPTED.
Your order will be delivered 15 days after reception of the payment by cheque with all the requested followings and after our bank approval and authentification.
If you wish to pay by transfer : Your order will be sent to you as soon as your credit transfer payment is made and delivered in our office.

10- Responsibility and limits
The buyer is responsible for the choice, the keeping and the use of the goods at the time the carrier gets the package .The buyer must not use goods which dates have expired or been defected by heat or any problem during carriages or for any other cause .
In any case" Passionnement Terroir " cannot be responsible for any damage of that sort, nor the non-respect of laws in the foreign country.
It is the responsibility of "Passionnement Terroir " to respect the French regulations about the present list of goods on the website. It is the responsibility of the buyer to check the import, the use of goods in the country of the delivery. The non-respect of the following shall be considered as events of "force majeure" including total or partial strikes, revolution, war, fire, flooding, acts attributed to a third part and all and any external occurrences likely to delay or prevent the performance of the seller's obligation. Whatever the eventual complaint is justified, the obligation of the seller is limited to pay the lowest price of the following : cost of direct prejudice or cost of the order.
11- Data protection
All personal information provided when shopping on-line are governed by the French law n° 78-17 (6 January 1978) relative to data capture and Liberties. The buyer has rights to see and change, for personal convenience, the data by contacting us via E-mail, fax, or writing. Those information can be shared with others unless a written refusal sent to the seller.
12-Laws and jurisdiction
The present contract is only ruled by the French law. Any dispute relative to the validity, the interpretation or execution of this contract shall be submitted to Courts having jurisdiction where Passionnement Terroir is registered.
